Restrictions regarding issuance of work permit

• After entering into an employment agreement with a foreign national the employer must notify territorial subdivision of employment service (within 3 days) and inspectorate of the Federal Tax Service of Russia (within 10 days) 

• The employer must provide foreign national's compliance with the rules of staying within the territory of Russia. The employer shall incur all financial and medical expenses as well as expenses associated with staying, traveling and departure of the foreign national 

• The employer must notify migration service in case of violation of an employment agreement by the foreign national employee. Moreover, the employer must notify migration service in case of anticipatory repudiation of the agreement 

• The employer shall migration-register his foreign national employee at the address the company’s location (notifying registration) 

• A foreign national is entitled to work within the territory of the subject of Russia where he has obtained work permit (where the employing company is registered as a legal entity) 

• A foreign national  must be able to speak Russian language at least on basic level in order to work in area of housing and utilities infrastructure, retail trade or public services 

• According to the rules in effect a foreign national cannot:
  
  — work at a company which is engaged in retail of any alcoholic beverages (including beer) if the number of foreign national employees is more than 25% of the total number of employees
  
  — work at a company that is engaged in retail of pharmaceutical goods
  
  — work at a company which is engaged in retail at markets and stallage and other places outside of the retail stores
  
  — work at a company which is engaged in any sport activities if the number of foreign national employees is more than 25% of the total number of employees 

• In order to obtain work permit a foreign national is obliged to acquire a statement of good health within the territory of Russia (within the territory of the subject of Russia where he/she applies for work permit). As a rule, such statements shall be issued by certain state treatment centers or medical institution “accredited” by migration service 

• A foreign national has freedom of movement within the territory of Russia except for the territories that require a special permission for entrance
