Estimation of specialist’s qualification

Under the Russian laws employer is entitled to evaluate qualification of his potential employee (a foreign national HQS) independently. Therefore, he takes all the corresponding risks (as an employer always does when hiring any person regardless of the level of potential employee’s qualification).

It means that from the perspective of the Migration Service the only criteria for assessment of qualification is the wage rate of a foreign national HQS. Everything else is left to the discretion of an employer.

Obviously, this rule of law is advantageous to all law-abiding employers since they are free to find and hire any suitable specialists without facing bureaucratic hurdles while dealing with the Migration Service.

However, it is also obvious that this “freedom” makes possible for different kinds of fraudsters of to create shell companies which would hire foreign nationals without any qualification at all…
